1. Acceptance of Terms

By accessing or using PostWing Pro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all visitors, registered users, and subscribers of PostWing Pro. By creating an account, you represent that you are at least 16 years of age and have the legal capacity to enter into a binding agreement.

2. Description of Service

PostWing Pro provides an all-in-one SaaS automation platform that allows users to:

• Connect and manage accounts across Facebook, Instagram, X (Twitter), TikTok, Threads, Reddit, and Pinterest via official developer APIs
• Schedule and automatically publish text, image, and multimedia posts to selected social channels
• Generate viral social media copy and ideas using third-party AI services (OpenAI GPT-4, DALL-E, OpenRouter)
• View unified post engagement analytics (likes, comments, shares, views, and followers)
• Automate daily publishing schedules via Auto-Pilot AI mode

The Service is provided on an "as is" and "as available" basis, subject to the terms and conditions set out herein.

3. Account Registration

3.1 Account Requirements

To use PostWing Pro, you must register for an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are solely responsible for all activities that occur under your account. You agree to:

• Immediately notify us of any unauthorized use of your account
• Use a strong, unique password not used on other services
• Not share your account credentials with third parties
• Log out from shared or public devices

3.3 One Account Policy

Each user may maintain one personal account. Creating multiple accounts to circumvent plan limits is prohibited and may result in suspension of all accounts.

4. Acceptable Use Policy

You agree not to use PostWing Pro to:

• Publish spam, unsolicited messages, or low-quality content at scale
• Violate Meta's Community Standards or Terms of Service
• Post content that is illegal, hateful, abusive, defamatory, or discriminatory
• Infringe upon intellectual property rights of others
• Post misleading, false, or deceptive content
• Attempt to scrape, reverse-engineer, or exploit our platform
• Use the Service to conduct phishing, malware distribution, or fraud
• Circumvent or attempt to circumvent plan limits or security measures
• Use AI-generated content to impersonate individuals or organizations

You are solely responsible for all content posted through our platform and for ensuring that it complies with applicable laws and Meta's policies.

5. Social Media Platform Compliance & Third-Party APIs

PostWing Pro operates by integrating with third-party social media platform APIs. By using our Service, you agree that:

• You will comply with the terms and community standards of all connected networks:
  • Meta Platforms (Facebook, Instagram, Threads): Meta Terms and Developer Policies
  • X (Twitter): X Terms of Service and Developer Agreement
  • TikTok: TikTok Terms of Service and Developer Guidelines
  • Reddit: Reddit User Agreement and Developer Terms
  • Pinterest: Pinterest Terms of Service and API Guidelines
• You own or hold all required intellectual property rights for all content submitted through PostWing Pro.
• PostWing Pro is an independent software tool and is not affiliated with, endorsed by, or sponsored by Meta Platforms, X Corp, ByteDance/TikTok, Reddit Inc., or Pinterest Inc.
• Social network platforms may change their API availability, rate limits, or policies at any time, which may alter certain features. We are not responsible for account restrictions caused by user violations of third-party platform rules.

6. Subscription & Payments

6.1 Billing

Paid plans are billed monthly or annually via PayPal. By subscribing, you authorize PostWing Pro to charge your PayPal account on a recurring basis until you cancel.

6.2 Free Trial

Paid plans include a 14-day free trial. You will not be charged during the trial period. After the trial, your subscription will automatically begin unless cancelled.

6.3 Cancellation & Refunds

• You may cancel your subscription at any time from the Plans & Billing page
• Access continues until the end of the current billing period
• Refunds are available within 7 days of initial purchase if you have not used the service
• Annual subscriptions may receive pro-rated refunds within 30 days of purchase
• No refunds are issued for monthly subscriptions after the billing date

6.4 Plan Changes

You may upgrade or downgrade at any time. Upgrades take effect immediately. Downgrades take effect at the next billing cycle.

6.5 Price Changes

We reserve the right to change subscription prices. We will notify you at least 30 days before any price increase takes effect. If you do not cancel before the new price takes effect, you agree to the new pricing.

7. Intellectual Property

7.1 Our IP

PostWing Pro, its logo, design, software, and all related intellectual property are owned by PostWing Pro Ltd. You may not copy, modify, distribute, sell, or lease any part of our Service without express written consent.

7.2 Your Content

You retain ownership of all content you create and publish through our platform. By using PostWing Pro, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service.

7.3 AI-Generated Content

Content generated by AI features is provided for your use. You are responsible for reviewing AI-generated content before publishing. We make no claims of copyright ownership over AI-generated content.

8. Disclaimers & Limitation of Liability

We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure
• AI-generated content will be accurate, appropriate, or error-free
• Posts will be published at the exact scheduled time in all cases
• Facebook API changes will not affect Service functionality

To the maximum extent permitted by law, PostWing Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of revenue, loss of business, or reputational damage.

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Termination

9.1 Termination by You

You may close your account at any time via Settings → Danger Zone or by contacting support. Upon termination, your data will be deleted within 30 days, except where retention is required by law.

9.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice or refund, if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in fraudulent, abusive, or harmful conduct
• Fail to pay subscription fees
• Cause legal, regulatory, or reputational harm to PostWing Pro

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PostWing Pro is registered. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

For EU users, nothing in these Terms affects your statutory consumer rights under applicable EU law.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via:

• Email notification to your registered address
• A prominent notice in the application dashboard
• Updating the "Last Updated" date at the top of this page

Continued use of PostWing Pro after changes are published constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service and close your account.
